Summary
We were instructed by solicitors at a pre-litigation stage to research and advise on a complex offshore multicurrency investment fund. We were able to opine on the structure of the fund and how it operated. Additionally, we identified areas of any regulatory concern in respect of financial promotions to UK situs investors. Of note in this case was the complex and multi levelled charging and fee structure. After calculating the impact of the fees on investors it became clear that the investments were unsustainable. The multifaceted fee structure has gone on to form a component of training on investment costs and has been used in training for lawyers and at a number of business schools.
Final Result
As a consequence of the research and advice we were instructed to act as Expert Witnesses and a CPR35 complaint report was produced. The case settled before trial.
